Welcome to Macgie! These Terms of Service ("Terms") govern your access to and use of the Macgie website, mobile applications, and related services (collectively, the "Service") provided by Macgie Co. Ltd. ("Macgie," "we," "our," or "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use Macgie.

If you are under the age of majority in your jurisdiction, you represent that you have permission from your parent or legal guardian to use the Service.

2. Your Account

You may create an account using:

• Email
• Sign in with Apple
• Sign in with Google

You are responsible for:

• keeping your login credentials secure;
• maintaining accurate account information; and
• all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account.

3. The Service

Macgie is an AI-powered wardrobe and styling platform that may include features such as:

• Digital wardrobe management
• AI See on Me
• AI Stylist Chat
• Capsule Wardrobes
• Packing Lists
• Calendar Outfit Planning
• Outfit recommendations
• AI-generated styling suggestions
• Other features introduced from time to time

Some features may require a Premium subscription.

4. User Content

You may upload content including:

• Clothing photos
• Selfies
• Full-body photos
• AI-generated images
• Notes
• Tags
• Outfit information
• Other wardrobe-related content

You retain ownership of all content you upload.

By uploading content, you grant Macgie a worldwide, non-exclusive, royalty-free license to:

• store;
• process;
• display;
• modify;
• analyze; and
• use your content

solely for the purpose of operating and improving the Service, including generating outfit recommendations, AI visualizations, wardrobe organization, and related functionality.

This license ends when your content is deleted from our systems, except where retention is required by law or necessary for backup and security purposes.

5. AI Features

Macgie uses artificial intelligence to provide styling recommendations and image generation.

AI-generated outputs are intended for informational, creative, and entertainment purposes only.

You acknowledge that:

• AI suggestions may be inaccurate.
• AI may misunderstand your preferences.
• Generated outfits may not match real-world clothing fit.
• Generated images may differ from your actual appearance.
• Colors, proportions, textures, and garment details may not be perfectly represented.
• Outfit recommendations are suggestions, not professional fashion advice.

You remain solely responsible for any decisions made based on AI-generated content.

6. AI Image Processing

Features such as AI See on Me may analyze uploaded selfies, full-body photographs, and clothing images.

These features use machine learning models to create personalized visualizations.

Macgie does not guarantee that generated images accurately represent:

• your body shape;
• facial features;
• clothing fit;
• proportions;
• colors; or
• real-life appearance.

AI-generated images are simulations only.

7. Premium Subscription

Macgie offers Free and Premium plans.

Premium subscriptions may be purchased:

• through the Apple App Store; and
• through our website.

Subscription fees are billed in advance and renew automatically unless cancelled before the renewal date.

Apple App Store purchases are governed by Apple's billing policies.

Web subscriptions are governed by the billing terms presented during purchase.

Prices may change in the future, but changes will not affect an active billing period.

8. Acceptable Use

You agree not to:

• violate any law;
• upload illegal content;
• impersonate another person;
• harass or abuse other users;
• upload content you do not own;
• infringe copyrights or trademarks;
• interfere with the Service;
• scrape or copy our database;
• reverse engineer our software;
• bypass security measures;
• use bots without permission;
• distribute malware;
• use Macgie to develop competing AI systems.

9. Intellectual Property

The Service, including its software, design, trademarks, logos, graphics, AI systems, and content (excluding User Content), is owned by Macgie or its licensors.

These Terms do not grant ownership of our intellectual property.

10. Privacy

Your use of Macgie is also governed by our Privacy Policy.

Please review it to understand how we collect, use, and protect your information.

11. Data and AI Training

Macgie processes uploaded images and wardrobe information solely to provide requested features.

Unless you explicitly consent, your personal photos, selfies, and wardrobe images will not be used to train general-purpose AI models.

We may use anonymized and aggregated usage data to improve the Service, provided such data cannot reasonably identify you.

12. Third-Party Services

Macgie may integrate with third-party providers, including authentication providers, payment processors, cloud infrastructure, and AI service providers.

Your use of those services may also be subject to their own terms and privacy policies.

Macgie is not responsible for the practices of third-party services.

13. Account Suspension and Termination

We may suspend or terminate your account if you:

• violate these Terms;
• engage in fraudulent activity;
• abuse the Service;
• create security risks;
• misuse AI features;
• infringe intellectual property rights.

You may stop using Macgie at any time and may delete your account in accordance with our Privacy Policy.

Termination does not affect any rights or obligations that arose before termination.

14. Disclaimers

The Service is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, Macgie disclaims all warranties, whether express, implied, or statutory, including warranties of:

• merchantability;
• fitness for a particular purpose;
• non-infringement; and
• uninterrupted availability.

We do not guarantee that the Service will always be secure, error-free, or uninterrupted.

15. Limitation of Liability

To the fullest extent permitted under applicable law, Macgie Co. Ltd., its officers, employees, directors, affiliates, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of the Service.

Where liability cannot be excluded, our total liability shall not exceed the greater of:

• the amount you paid to Macgie during the twelve (12) months preceding the claim; or
• SGD 100.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

16. Indemnification

You agree to indemnify and hold harmless Macgie Co. Ltd., its officers, employees, affiliates, licensors, and partners from any claims, damages, losses, liabilities, costs, or expenses arising from:

• your use of the Service;
• your User Content;
• your violation of these Terms; or
• your violation of any law or third-party rights.

17. Changes to the Service

We may modify, suspend, discontinue, or update any part of the Service at any time.

Where required by law, we will provide notice of material changes.

18. Changes to These Terms

We may update these Terms from time to time.

Material changes will become effective after notice is provided through the Service or by other appropriate means.

Continued use of Macgie after the effective date constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of the Republic of Singapore, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Singapore, unless otherwise required by applicable consumer protection laws.
